1. Notification of Alleged Copyright Infringement

If you are a legitimate copyright owner (or an authorized agent legally acting on behalf of one) and you hold a sincere, good-faith belief that your protected copyrighted work has been reproduced, published, distributed, or displayed on the Geraialya platform in a manner that constitutes direct copyright infringement, you are invited to submit a formal written Notification of Alleged Infringement to our designated DMCA Agent.

To be legally effective under Section 512(c) of the DMCA, your written infringement notice must be comprehensive and include all of the following specific elements:

• Identification of the Copyrighted Work: A precise and detailed description of the copyrighted work that you claim has been infringed, including official registration numbers if applicable, or a representative representative inventory list of the works in question.
• Identification of Infringing Material: Sufficiently detailed information identifying the exact location—such as specific product URLs, image links, or precise placement paths within geraialya.com—of the material you claim is infringing, enabling our technical team to locate and verify it instantly.
• Complainant Contact Information: Your full legal name, physical mailing address, telephone number, and a valid email address at which our administrative staff may contact you promptly.
• Statement of Good Faith Belief: An explicit statement affirming that you hold a genuine, good faith belief that the disputed use of the material is unauthorized by the copyright owner, its legal agent, or applicable statutory law.
• Statement of Accuracy & Legal Authorization: A formal statement, sworn under penalty of perjury, confirming that the information contained within your notification is completely accurate and that you are either the exclusive copyright owner or are legally authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Valid Signature: A physical or secure electronic signature of the copyright owner or a representative person authorized to act directly on their behalf.

2. Counter-Notification Procedure

If you are a vendor, creator, or user of our platform who believes in good faith that your content, product listing, or material was removed or disabled from geraialya.com as a result of a mistake, administrative error, or wrongful misidentification, you have the statutory right to file a formal Counter-Notification with our designated DMCA Agent.

To be valid under the DMCA, your written counter-notification must be submitted via email and must incorporate all of the following mandatory components:

• Identification of Removed Material: A specific, clear description of the material that has been removed or disabled, along with the precise location (URL or webpage link) where the material appeared prior to being removed or disabled.
• Statement of Good Faith Belief: A sworn statement, made under penalty of perjury, affirming your good faith belief that the subject material was removed or disabled as a result of an operational mistake or misidentification.
• Contact Information & Consent to Jurisdiction: Your full legal name, physical mailing address, phone number, and email address. Additionally, you must include a statement expressing your formal consent to the jurisdiction of the Federal District Court for the judicial district in which your physical address is located (or if your address is outside the United States, any judicial district in which Geraialya may be found), and that you will accept official service of process from the original complaining party or their designated agent.
• Valid Signature: Your physical or electronic signature.

Upon our receipt of a fully compliant counter-notification, Geraialya will promptly forward a copy of the document to the original complaining party, notifying them that we may replace the removed material or restore access to it within 10 to 14 business days, unless our designated agent receives formal notice that the copyright owner has filed a court action seeking a restraining order or injunction against the alleged infringer.

3. Designation of DMCA Agent and Contact Information

We have registered our official designated agent with the U.S. Copyright Office to receive formal notifications of claimed copyright infringement in strict accordance with the Digital Millennium Copyright Act. All official DMCA notices, counter-notices, and legal inquiries must be sent exclusively to our designated agent via the official contact information listed below. Submissions routed through alternate customer support channels will experience processing delays.

It is the established policy of Geraialya to accommodate and never interfere with standard, recognized technical measures used by copyright owners to protect their creative assets. In appropriate circumstances and at our sole discretion, we maintain the right to terminate accounts or restrict access for users who are determined to be repeat copyright infringers.
